Terms and Conditions of Service

These Terms and Conditions of Service (the “Agreement”) apply to all Pretoria WISP Pty Ltd (“Pretoria WISP”) subscribers and users of its services. By accessing the Internet via a Pretoria WISP account (or any server hosted on any Pretoria WISP network), you agree to these Terms and Conditions. If you do not agree to these conditions, your only recourse is to terminate your account.

1. Definitions

  • Subscriber: Refers to any individual or business entity subscribing to or using Pretoria WISP services, including Open Access WiFi services.
  • Service: Refers to the Internet, Open Access WiFi Network, and related services provided by Pretoria WISP.
  • Equipment: Refers to all hardware provided and installed by Pretoria WISP for the purposes of accessing or utilizing the Service.

2. Acceptable Use

2.1. The Service may only be used for lawful purposes. Subscribers are prohibited from transmitting unlawful, threatening, abusive, defamatory, vulgar, obscene, profane, hateful, or otherwise objectionable information of any kind.

2.2. Subscribers may not engage in conduct that would constitute a criminal offense, infringe upon third-party rights, or violate any local, national, or international statutes, rules, regulations, or treaties.

2.3. Redistribution or sharing of the Service, including the Open Access WiFi Network, without written consent from Pretoria WISP is prohibited.

2.4. Pretoria WISP reserves the right to suspend or terminate accounts involved in spamming, malware distribution, or any other prohibited activity, without notice.

3. Open Access WiFi Network

3.1. Access and Use

  • The Open Access WiFi Network is accessible to the public in designated areas.
  • Users may access the network via one-time click login for limited free daily access or by purchasing data packages as per Clause 3.2.

3.2. Free Access Policy

  • Each device is eligible for 15 minutes of free access daily, after which access requires the purchase of a data package.

3.3. Data Packages

  • The following data packages are available for purchase:
    • 1GB: R10
    • 5GB: R30
    • 15GB: R35
  • Purchased data is valid for 30 days and is non-refundable.

3.4. Payment

  • Currently, only EFT (Electronic Funds Transfer) payments are accepted. Additional payment options will be available in 2025.

3.5. Prohibited Use

  • The Open Access WiFi Network is strictly for individual use. Any attempt to operate a home WiFi network or for commercial use without authorization is prohibited.

3.6. Performance

  • The Open Access WiFi Network operates on a best-effort basis with speeds capped at 15 Mbps, depending on demand and network conditions.

4. Privacy and Confidentiality

4.1. Pretoria WISP will not intentionally monitor or disclose private email messages or browsing data unless required by law or court order.

4.2. Data collected from Open Access WiFi Network users (e.g., login and usage data) is used solely for network management and performance optimization.

4.3. Subscribers must maintain the confidentiality of their account passwords and are responsible for all use and liability resulting from access to the Service with their password.

5. Installation and Network Design

5.1. Pretoria WISP offers professional installation and network design services.

5.2. Subscribers have seven days after installation to report issues or concerns to Pretoria WISP. Issues raised after this period may not be eligible for resolution at Pretoria WISP’s expense.

6. Goods and Handling Fees

6.1. Any goods sold by Pretoria WISP are subject to a 15% handling fee for returns or exchanges.

6.2. Pretoria WISP is not liable for issues caused by third-party errors, network faults, or installations by external entities.

7. Limitation on Liability

7.1. Pretoria WISP is not liable for interruptions or issues arising from external networks or third-party equipment, including the Open Access WiFi Network.

7.2. Service interruptions caused by unforeseen events, network congestion, or maintenance are addressed on a best-effort basis.

8. Content

8.1. Pretoria WISP does not control or endorse the accuracy or reliability of any information transmitted via its services, including the Open Access WiFi Network.

9. Indemnification

9.1. Subscribers agree to defend, indemnify, and hold Pretoria WISP harmless from any claims arising from their use of the Service, including the Open Access WiFi Network.

10. Termination of Service

10.1. Pretoria WISP reserves the right to terminate Service without notice for violation of these Terms and Conditions.

11. Miscellaneous

11.1. This Agreement is governed by South African law.

11.2. Pretoria WISP reserves the right to amend these Terms and Conditions at any time.
