Pretoria WISP (Pty) Ltd – Terms and Conditions of Service

These Terms and Conditions of Service (“Agreement”) apply to all subscribers, users, and customers of Pretoria WISP (Pty) Ltd (“Pretoria WISP”). By accessing or using Pretoria WISP services, including the Open Access WiFi Network, you confirm that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, your sole remedy is to discontinue use of the Service.


1. Definitions

Subscriber
Any individual or legal entity that subscribes to, accesses, or uses Pretoria WISP services, including Open Access WiFi services.

Service
Internet connectivity, Open Access WiFi Network access, and any related services provided by Pretoria WISP.

Equipment
All hardware supplied, installed, or configured by Pretoria WISP to enable access to the Service.


2. Acceptable Use Policy

2.1. The Service may only be used for lawful purposes. Subscribers may not transmit, store, or distribute content that is unlawful, threatening, abusive, defamatory, obscene, hateful, or otherwise objectionable.

2.2. Subscribers may not engage in conduct that constitutes a criminal offence, infringes third-party rights, or violates any applicable local, national, or international laws or regulations.

2.3. Redistribution, resale, or sharing of the Service, including the Open Access WiFi Network, without prior written consent from Pretoria WISP is strictly prohibited.

2.4. Pretoria WISP reserves the right to suspend or terminate accounts involved in spamming, malware distribution, network abuse, or any prohibited activity, with or without notice.


3. Open Access WiFi Network

3.1. Access and Use

The Open Access WiFi Network is available to the public in designated areas. Users may access the network via limited free access or by purchasing a data package.

3.2. Free Access Policy

Each device is eligible for 15 minutes of free internet access per day. Continued access thereafter requires the purchase of a data package.

3.3. Data Packages

Available data packages include:

  • 1GB – R18

  • 15GB – R149

  • 25GB – R199

All purchased data is valid for 30 days from activation and is non-refundable and non-transferable.

3.4. Payment

Pretoria WISP accepts multiple electronic payment methods, including EFT and other supported digital payment options.

3.5. Prohibited Use

The Open Access WiFi Network is intended for individual personal use only. Operating a private home network, reselling access, or using the Service for commercial purposes without written authorisation is prohibited.

3.6. Performance

The Open Access WiFi Network operates on a best-effort basis, with speeds capped at 15 Mbps, subject to demand, coverage, and network conditions.


4. Privacy and Confidentiality

4.1. Pretoria WISP does not intentionally monitor private communications or browsing activity except where required by law, regulation, or court order.

4.2. Limited login and usage data may be collected for network management, security, compliance, and performance optimisation purposes.

4.3. Subscribers are responsible for maintaining the confidentiality of their account credentials and accept liability for all activity conducted using their account.


5. Installation and Network Design

5.1. Pretoria WISP offers professional installation and network design services where applicable.

5.2. Subscribers must report any installation-related issues within seven (7) days of completion. Issues raised after this period may not qualify for remediation at Pretoria WISP’s expense.


6. Goods, Returns, and Handling Fees

6.1. Goods sold by Pretoria WISP are subject to a 15% handling fee for returns or exchanges.

6.2. Pretoria WISP is not liable for faults or damages caused by third-party equipment, installations, power issues, or external network failures.


7. Limitation of Liability

7.1. Pretoria WISP shall not be held liable for service interruptions, performance degradation, or outages caused by third-party networks, power failures, acts of nature, or customer-owned equipment.

7.2. Planned maintenance, unforeseen events, or network congestion are handled on a best-effort basis, and no uptime guarantee is implied unless expressly agreed in writing.


8. Content Disclaimer

Pretoria WISP does not control, verify, or endorse any content transmitted over its network and accepts no responsibility for the legality, accuracy, or reliability of such content.


9. Indemnification

Subscribers agree to indemnify, defend, and hold harmless Pretoria WISP, its directors, employees, and agents against any claims, damages, losses, or costs arising from misuse of the Service or breach of this Agreement.


10. Suspension, Termination, and Subscriber Obligations

10.1. Non-Payment and Service Suspension

Pretoria WISP services are provided on a subscription basis and are not offered as a prepaid or on-demand service.

Failure to settle an account by the due date will result in automatic suspension of the Service, without notice. Access will remain suspended until the outstanding balance is paid in full.

Pretoria WISP reserves the right to suspend, restrict, or terminate services for non-payment, breach of these Terms and Conditions, or misuse of the Service.


10.2. Reconnection Fees

Where a service has been suspended due to non-payment, reconnection fees may be charged at the sole discretion of Pretoria WISP.

Reconnection fees, where applicable, are determined based on:

  • Duration of suspension

  • Administrative effort required

  • Network re-provisioning or re-authentication required

  • Subscriber payment history

Payment of outstanding balances does not automatically guarantee immediate reconnection.


10.3. Month-to-Month Subscriptions

Subscribers on month-to-month plans must provide a minimum of 30 days’ written notice to cancel the Service.

Non-payment does not constitute notice of cancellation.

Accounts that fall into arrears without proper cancellation remain billable until formal notice is received or the Service is formally terminated by Pretoria WISP.


10.4. Tenanted Properties

In rental or tenanted properties:

  • Installed routers and related equipment remain on the premises for use by the next tenant.

  • Pretoria WISP does not charge reconnection fees where a new tenant takes over an existing, active service.


10.5. Equipment Responsibility and Liability

All equipment installed by Pretoria WISP remains its property unless otherwise agreed in writing.

If equipment is removed, stolen, or damaged:

  • Standard router replacement fee: up to R650

  • Gigabit router replacement fee: minimum R850

Pretoria WISP reserves the right to recover replacement costs before restoring or continuing service.


10.6. Right of Termination

Pretoria WISP reserves the right to terminate services without notice in cases of repeated non-payment, abuse of the Service, or violation of these Terms and Conditions.


10.7. CPA Fairness

All fees, suspensions, reconnections, and terminations are applied fairly, reasonably, and in good faith, in accordance with the Consumer Protection Act, 68 of 2008.


11. General

11.1. This Agreement is governed by the laws of the Republic of South Africa.

11.2. Pretoria WISP reserves the right to amend these Terms and Conditions at any time. Continued use of the Service constitutes acceptance of the updated terms.


12. Call-Out Fees and On-Site Support

12.1. Definition

A call-out refers to any on-site visit requested by a Subscriber for diagnostics, troubleshooting, inspections, repairs, or support, whether or not work is ultimately performed.

12.2. Call-Out Fees

Pretoria WISP charges the following flat call-out fees:

  • R500 — During business hours (Monday to Friday, excluding public holidays)

  • R750 — Weekends and public holidays

These fees include on-site attendance and basic fault diagnostics.

12.3. Fault Attribution

Where a fault is determined to be:

  • Within Pretoria WISP’s core network or infrastructure, no call-out fee will apply.

  • Caused by customer-owned equipment, internal wiring, power issues, third-party devices, misuse, or environmental factors, the applicable call-out fee will be charged.

The determination of fault origin rests solely with Pretoria WISP.

12.4. Non-Refundable Nature

Call-out fees are non-refundable once a technician has been dispatched or has arrived on site.

12.5. Additional Work

Any additional labour, materials, cabling, or equipment required beyond basic diagnostics will be quoted separately and billed accordingly, subject to Subscriber approval.

12.6. Right of Refusal

Pretoria WISP reserves the right to refuse on-site support where outstanding balances exist, access is unsafe or obstructed, or the request falls outside the scope of Pretoria WISP’s services.

12.7. Labour Charges

The call-out fee covers attendance and basic diagnostics only. Additional labour may be charged at an hourly rate, which will be communicated prior to work commencing.

12.8. Implied Consent

By requesting on-site support, the Subscriber provides implied consent for diagnostic work and applicable charges to be billed in accordance with these Terms and Conditions.

12.9. Access and Delays

Subscribers must ensure reasonable access to the premises at the agreed time. Excessive waiting time or inability to gain access may be billed as labour time or result in forfeiture of the call-out fee.

12.10. Customer Equipment Disclaimer

Pretoria WISP provides no warranty on customer-owned equipment, cabling, or infrastructure, even where assistance or configuration is provided.

12.11. After-Hours Support

After-hours, weekend, and public holiday support is provided on a best-effort basis and subject to availability.


13. Power, Electrical Events, and Environmental Factors

13.1. Pretoria WISP is not responsible for service interruptions or equipment damage caused by power outages, load shedding, surges, lightning, inadequate earthing, or electrical faults on the Subscriber’s premises.

13.2. Subscribers are responsible for adequate power protection, including surge protection and UPS solutions where required.

13.3. Equipment damaged due to electrical or environmental events is not covered under any service warranty.


14. Service Levels

Unless expressly agreed to in writing, Pretoria WISP provides all services on a best-effort basis and does not guarantee uptime, latency, throughput, or fault resolution times.


15. Remote Support and Diagnostics

By using the Service, Subscribers consent to Pretoria WISP performing reasonable remote diagnostics, monitoring, and configuration changes necessary to maintain or restore service.


16. Network Changes and Upgrades

Pretoria WISP reserves the right to modify, upgrade, or reconfigure its network infrastructure to improve performance, security, or capacity. Temporary service interruptions may occur as a result of such changes.


17. Force Majeure

Pretoria WISP shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, civil unrest, power grid failures, or government actions.
